Terms and Conditions

Welcome to Catrina Games! These Terms and Conditions (“Terms”) constitute a legal agreement between you (“User,” “Player,” or “you”) and Catrina Games (“we,” “our,” or “us”) regarding your use of our video games, website, and related services (collectively, the “Services”).

By downloading, installing, accessing, or playing our games on any platform (including but not limited to Steam, Google Play, Epic Games Store, Itch.io, GOG, or Humble Bundle), you agree to be bound by these Terms.

IF YOU DO NOT AGREE TO THESE TERMS, DO NOT INSTALL OR USE OUR SERVICES.

1. License to Use

Subject to your compliance with these Terms, Catrina Games grants you a personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to install and use our Services for your personal, non-commercial entertainment use only.

Definition of Software Product: The term “Software Product” or “Services” includes the video game software, and all associated media, printed materials, and online documentation. It specifically encompasses all content within the game, including but not limited to: themes, characters, names, stories, dialog, locations, artwork, animations, sounds, musical compositions, audio-visual effects, and moral rights. All strictly belong to Catrina Games and its licensors.

You acknowledge that you do not own the game; you are purchasing a limited license to use it. We reserve all rights not expressly granted to you.

2. User Accounts and Platforms

2.1 Third-Party Accounts

To access our games, you may need an account with a third-party platform (e.g., a Steam Account or Google Account). You are responsible for maintaining the security of those accounts. We are not responsible for any security breaches on third-party platforms.

2.2 Age Requirements

You must be at least 13 years old to use our Services. If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you represent that your legal guardian has reviewed and agreed to these Terms.

3. Virtual Goods and Purchases

3.1 No Real World Value

Our games may include virtual currency, items, or skins (“Virtual Goods”). Virtual Goods have no real-world monetary value and cannot be redeemed for real money, goods, or services from us or anyone else.

3.2 Refunds and Platform Rules

We do not process payments. All purchases are handled by the platform where you downloaded the game (e.g., Valve/Steam, Google).

  • Refunds: Any refund requests must be directed to the store where you made the purchase and are subject to that store’s refund policy (e.g., Steam Refund Policy).
  • We are not liable for payment failures or billing errors caused by third-party platforms.

4. Code of Conduct & Multiplayer (P2P)

4.1 Prohibited Activities

You agree not to:

  • Use cheats, automation software (bots), hacks, or malicious software intended to interfere with the Service or gain an unfair advantage in multiplayer modes.
  • Harass, abuse, or harm other users.
  • Use the Services for any illegal purpose.
  • Reverse engineer, decompile, or attempt to derive source code from our games (except as strictly permitted by applicable law or our Modding Policy).

4.2 Peer-to-Peer Interactions

Some of our games function using Peer-to-Peer (P2P) technology without dedicated servers. This means you connect directly to other players.

  • User Responsibility: We cannot monitor direct communications or interactions between players in real-time. You are solely responsible for your interactions with other players.
  • Disclaimer: Catrina Games expressly disclaims any liability for the conduct of any user or for any content shared directly between users during P2P sessions.

5. User Content & Modding Policy

5.1 User-Generated Content (UGC)

If our Services allow you to create, upload, or share content (such as custom levels, skins, or leaderboard names), you retain ownership of your content. However, you grant Catrina Games a worldwide, royalty-free, perpetual license to use, reproduce, and display that content in connection with the Service.

5.2 Modding Policy

We encourage our community to create modifications (“Mods”) to enhance the single-player experience of our games. We grant you a revocable, limited license to create and distribute Mods for our games, subject to the following strict conditions:

  • Non-Commercial: Mods must be distributed for free. You cannot sell Mods or gate them behind a paywall without our express written permission.
  • No Cheats in Multiplayer: Mods that provide an unfair advantage, automate gameplay, or ruin the experience for others in multiplayer/co-op modes are strictly prohibited and may result in a ban.
  • Respect IP Rights: Your Mod must not infringe on the intellectual property rights of third parties (e.g., do not use assets from other copyrighted games or movies).
  • Indemnification: You are solely responsible for the Mods you create. You agree to indemnify and hold Catrina Games harmless from any claims or damages arising from your Mods.

DISCLAIMER: Catrina Games does not vet or endorse any Mods. Players install Mods at their own risk. We are not responsible for any technical issues, data loss, or security breaches caused by the installation of third-party Mods.

6. Health Warning (Epilepsy)

PLEASE READ CAREFULLY: Some people may experience seizures when exposed to certain light patterns or flashing lights in video games. Even people who have no history of seizures or epilepsy may have an undiagnosed condition.

  • If you experience dizziness, altered vision, eye or muscle twitches, loss of awareness, disorientation, any involuntary movement, or convulsions, IMMEDIATELY STOP PLAYING and consult a doctor.

7. Updates and Hardware Requirements

We may occasionally provide updates, patches, or modifications to the Game that must be installed for you to continue playing effectively. Catrina Games reserves the right to:

  • Modify System Requirements: Improve or modify the Game in ways that may change the hardware or software requirements necessary to run it.
  • No Liability for Obsolescence: We are not liable if an update renders your hardware or operating system incompatible with the Game, even if your device met the minimum requirements at the time of initial purchase.

8. Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, CATRINA GAMES DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CATRINA GAMES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR USE, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

10. Export Controls

You agree to comply with all applicable export and import laws and regulations. You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a “terrorist supporting” country. You will not export or re-export the Game to any prohibited country, person, or entity.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United Mexican States (Mexico).

11.1 Jurisdiction

Any legal suit, action, or proceeding arising out of or related to these Terms shall be instituted exclusively in the federal or state courts located in Monterrey, Nuevo León, Mexico. You waive any objection to the venue or jurisdiction of such courts.
